(A) Rules for operation and exceptions. No motor vehicles, and for these purposes, motor vehicles include snowmobiles, motorcycles, motor bikes, mopeds and all other vehicles, whether powered electrically or by internal combustion engine, shall be operated on or permitted to be placed or parked within the city parks and other public lands of the city, except on designated surfaced thoroughfares and designated parking areas located therein, subject to time restrictions hereinafter contained.

(B) Restrictions. The City Council, by resolution duly enacted, ordains that except with a special permit previously issued by the City Council, it shall be unlawful for any motor vehicle, as defined herein, to be within the perimeter of the public parks and other public places of the city between the hours of 11:00 p.m. and 7:00 a.m. the following day official time, provided, however, this section shall not apply to the official vehicles of the city police, Maintenance Department, and other departments which are being used in the execution of the duties and obligations of such officers, agents, and employees of the city or in going to and returning from the performance thereof by such persons.

(C) Fees. The fees, in the event any are prescribed, shall be established by City Council.

(D) Parking restrictions not applicable to city streets. The provisions of this section are intended to regulate the presence of motor vehicles in public parks and other public places of the city but is not intended to apply to the public streets and thoroughfares of the city and parking places located outside of the perimeters of the public parks and other public properties of the city.

(E) Violations. Violations of the provisions of this section are deemed petty misdemeanors and persons duly convicted thereof shall be prosecuted in accordance with the laws of the state.
