A. The city is a governmental entity that is empowered by the Act to adopt development impact fee ordinances and as such is authorized, by Idaho Code section 67-8204A, to enter into the intergovernmental agreement with the district for the purpose of agreement to collect and expend fire district impact fees for system improvements as provided in this chapter.
B. The city and the district have entered into the intergovernmental agreement which is in full force and effect.
C. The intergovernmental agreement complies with this chapter and requires the district to be governed by and to fully abide by the provisions of this chapter.
D. Any amendments of the intergovernmental agreement shall be implemented by corresponding relevant amendments of this chapter which amendments shall not apply to any fire district impact fees then not expended and currently held in the trust fund. (Ord. 234, 3-1-2022)
