There shall be no encroachments, including fill, new construction, substantial improvements or any other development on city of Kooskia levees unless certification by a registered professional engineer or architect is provided demonstrating that encroachment shall not result in any damage to the levees or any increase in flood levels. In addition, any encroachments as described above, to the city of Kooskia levees, must be approved in advance by the Kooskia city council. Any person who encroaches on the levees without meeting the requirements as stated above is responsible for any costs incurred by the city to remove said encroachment. Any violation of this section is a general misdemeanor offense. (Ord. 169, 11-9-2011)
