On the failure of the holder of a permit, of this chapter, to make repairs as provided in the most recent and adopted "City of Kokomo Right-of-Way Excavation Handbook", the city may make such repairs as are deemed necessary to bring a right-of-way into compliance and may charge the associated permittee up to 110% of the cost of bringing the right-of-way into compliance.
