§ 30A.02 COUNCILMANIC DISTRICTS.
   (A)   As used in this section: “CITY” refers to the City of Kokomo; “COUNCIL” refers to the Common Council of the city; “PRECINCT” refers to the precinct as established by the Board of Commissioners of the County of Howard as approved by the State Election Board.
   (B)   The Council is composed of nine members. Six members are elected from the districts established under this section. Three members of the Council are elected at large by the voters of the whole city.
   (C)   The six council districts are described as follows (descriptions include only those portions of the listed precincts which are within the city’s corporate boundaries):
      (1)   District One - that part of the city located in Precincts 101, 102, 103, 104, 105, 107, 108, 201, 301, 1 Clay 1, 1 Clay 2, Center B, and 1 Howard 1.
      (2)   District Two - that part of the city located in Precincts 202, that portion of 203 south of Monroe Street, 204, 205, 206, 207, 303, and 401.
      (3)   District Three - that part of the city located in Precincts 302, 304, 305, 306, 404, 405, Center C, 3 Howard 1, 3 Taylor 1, 3 Taylor 2, 3 Taylor 3, 3 Taylor 4, and Taylor C.
      (4)   District Four - that part of the city located in Precincts 402, 403, 406, 501, 502, 604, Harrison B, and 6 Harrison 1.
      (5)   District Five - that part of the city located in Precincts 503, 3 Harrison 1, 5 Harrison 1, 5 Harrison 2, 6 Harrison 2, 4 Taylor 1, and 5 Taylor 1.
      (6)   District Six - that part of the city located in Precincts 106, 109, 110, that portion of 203 north of Monroe Street, 601, 602, 603, and 605.
   (D)   Attached to Ord. 7072 as Exhibit A are maps showing the boundaries of each Council district collectively and separately (the “maps”) which maps are incorporated herein by reference. Two copies of the foregoing maps are on file in the office of the City Clerk for public inspection as required by I.C. 36-1-5-4.
   (E)   If a conflict exists between the maps and the descriptions set forth in division (C) above (the “descriptions”), in accordance with I.C. 3-5-10-9, the descriptions shall determine the boundaries of the Council district.
   (F)   If any territory in the city is not included in one of the Council districts, in accordance with I.C. 3-5-10-10, the excluded territory shall be included in the Council district that:
      (1)   Is contiguous to that territory; and
      (2)   Contains the least population of all Council districts contiguous to that territory.
   (G)   If any territory in the city is included in more than one of the Council districts, in accordance with I.C. 3-5-10-11, the territory shall be included in the Council district that:
      (1)   Is one of the districts in which the territory is described in this section;
      (2)   Is contiguous to that territory; and
      (3)   Contains the least population of all Council districts contiguous to that territory.
   (H)   In accordance with I.C. 36-4-6-3(1) this section must be construed, if possible, to comply with the provisions of I.C. 36-4-6-3. The provisions of this section are severable and if any provision is found to be invalid, the invalidity shall not affect the other provisions of this section that can be given effect without the invalid provision.
