§ 31.16 DEPARTMENT OF PUBLIC WORKS.
   (A)   There is hereby created a Department of Public Works to be staffed by a Director of Public Works and other employees deemed necessary.
   (B)   The Department of Public Works shall include the following functions and responsibilities:
      (1)   Maintain or supervise the repairing of infrastructure and appurtenances owned or controlled by the township, including, but not limited to, sidewalks, the water supply and distribution system, including hydrants, sewage collection system, and storm water collection system;
      (2)   Coordinate with the Building and Grounds Manager to ensure that township-owned parks, playgrounds, and recreational facilities are adequately maintained;
      (3)   Maintaining and when necessary, planting trees and other vegetation on rights-of-way; and
      (4)   Any other functions and responsibilities that may be assigned to the Department by the ordinances and resolutions adopted by the Township Board or by any directives provided by the Township Manager.
   (C)   The Township Manager shall appoint a Director of Public Works, who shall be affirmed by the Township Board of Trustees, and the Township Manager shall be the immediate supervisor of the Director of Public Works. The Director of Public Works shall be responsible for the hiring of all personnel of the Department of Public Works, subject to approval of the Township Manager. The Director of Public Works shall be the immediate supervisor of all personnel of the Department of Public Works.
   (D)   This subchapter shall not limit the authority of the Township Board to contract for the services provided by the Department of Public Works, the Township Board’s authority to have another governmental entity provide those services as authorized by statute or the Michigan Constitution of 1963, or establishing an authority or other entity recognized by the laws of the State of Michigan.
   (E)   The Township Manager shall appoint a person to serve as Acting Director of Public Works during the period of a vacancy in the position of the Director of Public Works or during the absence of the Director of Public Works when such vacancy or absence is for a period longer than two weeks. The Director of Public Works, with approval of the Township Manager, may designate an individual to act in the absence of the Director of Public Works during an absence from the duties of the Director of Public Works when the absence is for a period of two weeks or less.
