For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALCOHOLIC BEVERAGE. Any beverage having an alcoholic content of more than 0.5% by volume.
CONTINUOUSLY CRUISE. The repeated driving of a motor vehicle in and through a township park without stopping for the purpose of using a township park.
DIRECTOR. The moderator of all Parks and Recreation Advisory Committee meetings and the person that assists in the coordination of all township parks activities. If the township employs a Superintendent of Parks, the Superintendent of Parks shall be the person who oversees all township park day to day activities.
DOG PARK. Any area within a township park that has been designated and established by resolution of the Township Board as an area where, subject to and in compliance with rules, policies and procedures established by the Township Board, dogs may be off the leash that is required in other areas of the township.
HUMAN-POWERED. Movement accomplished or propelled by human power, such as walking, running or by any vehicle or device which is designed and equipped to be propelled by human power, without any assistance by a motor or power unit (e.g., bicycle, roller skates, skateboard and wheel chair).
MOTOR VEHICLE. Any vehicle that is self-propelled, by any means whatever, including all devices in, upon or by which any person or property may be transported or drawn, excluding only those devices moved exclusively by human power. The term includes any trailer in tow of any size, kind or description. Exception is made for the use and operation of a motorized wheelchair by a person who ordinarily uses the equipment, township employees or others authorized by the township to perform inspection, repair or maintenance work, and to persons providing emergency medical or veterinary services, in the performance of their official or professional duties.
NON-MOTORIZED PATHWAY(S) or PATHWAY(S). An off-road hard-surfaced path that may be separated from motorized vehicular traffic by an open space or barrier, which has been designated, or designed and designated by the township for public use for human-powered travel or movement.
PARKS AND RECREATION ADVISORY COMMITTEE. The Committee appointed by the township to handle or deal with matters pertaining to parks and recreation located in the township.
PEDESTRIAN. A person who is walking, jogging, biking or running on a non-motorized pathway or within the township park(s).
PERSON(S). Any person, group of persons, firm, partnership, association, corporation, company or organization of any kind.
SUPERINTENDENT OF PARKS. The person employed as Superintendent of Parks, which oversees the day to day township park activities. In the absence of a hired Superintendent of Parks, the Township Supervisor or his or her designee shall serve in this capacity.
TOWNSHIP. The Township of Kochville, Saginaw County, Michigan.
TOWNSHIP BOARD. The Township Board, constituted as provided in § 70 of Revised Statutes of 1846, being M.C.L.A. §§ 41.70 et seq.
TOWNSHIP PARK(S). Any area or plat of land owned or operated by the township which is developed and used for public recreational purposes, including, but not limited to, landscaped tracts, picnic grounds, playgrounds, non-motorized pathway, motor vehicle drives and other recreational structures and facilities for the use and benefit of the public.
TOWNSHIP SUPERVISOR. The supervisor of the township elected under Chapter XVI of the Michigan election law, Pub. Act 116 of 1954, being M.C.L.A. §§ 168.341 to 168.373.
USER. Any person who is traveling on or is otherwise lawfully using a non-motorized pathway, as provided, and includes pedestrians.
VEHICLE. Any wheeled conveyance, whether motor powered, animal-drawn or self-propelled. Exception is made for baby carriages and similar devises.
