§ 91.04 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   APPLICANT. A property owner or the property owner's authorized legal agent who is submitting an application to construct a private road within the township.
   APPROVED PLANS. The plans submitted by the applicant and approved by the township as part of the approval process. APPROVED PLANS include notes and comments made by the township and its representatives and agents. The APPROVED PLANS do not include contracts, proposals and other documents unless specifically noted or approved by the township.
   BASEMENT. The right of an owner of property by reason of the ownership, to use the property of another for purposes of ingress, egress, utilities, drainage and similar uses.
   BOND. A type of contract bond which protects against loss due to the inability or refusal of a contractor to perform his or her contract. BONDS are required at the discretion of the township.
   HARDSHIP. The criteria for determining whether a hardship exists shall be the same criteria used to determine a hardship when a zoning variance is sought.
   LOT. A parcel of land; real estate.
   OWNERS OF THE PRIVATE ROAD. A natural person, firm, association, partnership, corporation or combination of any of these or any other person or entity having an interest in the private road involved.
   PLANNING COMMISSION. Kochville Township Planning Commission.
   PRIVATE ROAD. A privately owned (or controlled) and maintained street, road or any improved or unimproved surface, not dedicated to the County Road Commission as a public road, which provides the primary means of vehicular ingress and egress from a public road to two or more dwelling units, lots, parcels or principal buildings, whether created by a private right-of-way, easement or other device. PRIVATE ROAD does not include a field driveway or access point used primarily for agricultural purposes.
   TOWNSHIP. Kochville Township, Saginaw County, Michigan.
   TOWNSHIP ATTORNEY. An attorney appointed by the Township Board to the position of Township Attorney or any other person authorized by the Township Board to perform the duties of Township Attorney as set forth in this subchapter.
   TOWNSHIP BOARD. The Kochville Township Board of Trustees.
   TOWNSHIP CLERK. The Clerk of Kochville Township.
   TOWNSHIP ENGINEER/PLANNER. An engineer or planner appointed by the Township Board to the position of Township Engineer, Planner or any other person authorized by the Township Board to perform the duties of Township Engineer or Planner as set forth in this subchapter.
   TOWNSHIP OFFICIAL. Any individual employed by the township acting on behalf of the township.
   TOWNSHIP ZONING ADMINISTRATOR. The Zoning Administrator of Kochville Township.
