1105.01  FEES AND DEPOSITS.
   The schedule of fees and deposits related to land use is hereby established as follows:
   (a)   Official Information Packet and Forms.  A packet containing relevant portions of the Zoning Code and Building and Architectural Regulations and Requirements with required forms shall be provided at a cost of twenty-five dollars ($25.00).
   (b)   Zoning Code Amendments.  A fee of two hundred dollars ($200.00) shall accompany all applications to rezone property.
   (c)   Certificates of Compliance.  Fees relating to application for and issuance of a certificate of compliance are as follows:
      (1)   A fee in the amount of one hundred dollars ($100.00) for initial review of proposed plans by the Zoning Inspector.
      (2)   A fee in the amount of three hundred dollars ($300.00) for review of the proposed plans by the Architectural Consultant and the Architectural Board of Review.
      (3)   A fee in the amount of two hundred dollars ($200.00) incident to inspections during construction by the Zoning Inspector to determine compliance with the Zoning Code and mandates of the Architectural Board of Review.
      (4)   The total fees required by subsections (c)(1) to (3) hereof shall not exceed three percent (3%) of the estimated construction cost of the improvement as determined by the Building Inspector, but shall in no event be less than one hundred dollars ($100.00).
      (5)   Whenever a certificate of compliance is required and where construction work or activity is commenced prior to obtaining a certificate of compliance, the fees required shall be doubled.  Payments of such double fees shall not relieve any person from fully complying with any and all requirements, applicable codes and ordinances.

      (6)   Swimming pools shall be exempt from the fees set forth in subsections (c)(2) to (4) hereof.

   (d)   Occupancy Deposits.  Prior to the issuance of a certificate of compliance, an occupancy deposit shall be posted with the Village in an amount equal to one dollar ($1.00) per square foot of the total area of construction as determined by the Zoning Inspector, not to exceed three thousand dollars ($3,000), but in no event less than five hundred dollars ($500.00) per principle structure or two hundred dollars ($200.00) per accessory structure.
   (e)   Variances.  Each application for a variance shall be accompanied by a fee in the amount of one hundred fifty dollars ($150.00).
   (f)   Conditional Use Permits.  A fee of two hundred dollars ($200.00) shall accompany each application for a conditional use permit.
   (g)   Final Subdivision Plats.  The fee for review and processing of each final subdivision plat shall be two hundred fifty dollars ($250.00) plus fifty dollars ($50.00) per lot, payment of which shall be submitted with the subdivision plat.
   (h)   Minor Subdivision Plats.  The fee for review and processing of each minor subdivision plat shall be one hundred dollars ($100.00) plus fifty dollars ($50.00) per lot, payment of which shall be submitted with the minor subdivision plat.
   (i)   Subdivision Inspection Fees.  Subdivider shall be responsible for payment of an inspection fee equal to four percent (4%) of the estimated construction cost as determined by the Village Engineer.  Said inspection fees shall be submitted to the Clerk-Treasurer prior to the recordation of the subdivision plat.
   (j)   Right-of-Way Construction Permits.  Each request for a permit to work within the public right-of-way within the Village shall be accompanied by a fee of fifty dollars ($50.00).  (Ord.  3-95-03.  Passed 3-20-95.)
   (k)   Final Grade Inspection Fees.  A fee for final grade inspection performed by the Village Engineer shall be three hundred dollars ($300.00), paid contemporaneously with an application for a building permit.

   All checks for fees and deposits shall be made payable to the “Village of Kirtland Hills”.
