509.08  HOURS OF CONSTRUCTION.
   (a)   No excavating, carpentry work, brick laying, cement work, stone work, operations involving chain saws or any other form of labor shall be performed on the construction, maintenance or repair of underground utility lines, mains, sidewalks, streets, houses, structures or the cutting or trimming of trees in the Village on Sunday, on Saturday between the hours of 7:00 p.m. and 7:30 a.m. and on weekdays between the hours of 7:00 p.m. and 6:30 a.m. However, said activities may be performed within an enclosed structure or by the owner or a resident of the subject premises if said activity does not cause a nuisance.
   (b)   The general contractor, laborer or owner of the property upon which the activity referred to in subsection (a) hereof is to be performed may file a written application with the Zoning Inspector for an exemption from or an extension of the time of work. The application shall state, with specificity, the reason for the request including how the exemption or extension will service the public health, safety and general welfare of the Village residents, the hours of exemption or extension, including a description of the equipment which shall be used and noise generated. If the Zoning Inspector determines, in his or her sole discretion that an exemption or extension of the time would serve the public health, safety and general welfare of the Village residents or is necessary to meet a real and present emergency, the Zoning Inspector may issue a written permit granting an exemption or extension. The Zoning Inspector may include in the permit any restrictions, terms and conditions on the hours of work he or she deems appropriate.
   (c)   Whoever violates this section is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense. A separate offense shall be deemed to have been committed each hour during which a violation continues.
