§ 236.06  COOPERATIVE PURCHASING.
   (a)   Department of Administrative Services, Office of State Purchasing.
      (1)   The Mayor hereby requests authority, in the name of the city, to participate in state contracts which the Department of Administrative Services, Office of State Purchasing, has entered into for the purchase of supplies, services, equipment and certain materials pursuant to Ohio R.C. 125.04.
      (2)   The Mayor is hereby authorized to agree, in the name of the city, to be bound by all contract terms and conditions as the Department of Administrative Services, Office of State Purchasing, prescribes. Such terms and conditions may include a reasonable fee to cover the administrative costs which the Department incurs as a result of the city's participation in a contract. Further, the Mayor does hereby agree to be bound by all terms and conditions.
      (3)   The Mayor is hereby authorized to agree, in the name of the city, to directly pay the vendor, under each such state contract in which it participates, for items it receives pursuant to the contract, and the Mayor does hereby agree to directly pay the vendor.
      (4)   The Clerk of Council is hereby authorized to forward a certified copy of this subsection to the Department of Administrative Services, Administrator, Office of State Purchasing, upon request that this subsection be filed.

   (b)   Ohio Department of Transportation.
      (1)   The Mayor hereby requests authority, in the name of the city, to participate in contracts of the Ohio Department of Transportation for the purchase of machinery, materials, supplies or other articles which the Department has entered into pursuant to Ohio R.C. 5513.01(B).
      (2)   The Mayor is hereby authorized to agree, in the name of the city, to be bound by all terms and conditions as the Director of Transportation prescribes.
      (3)   The Mayor is hereby authorized to agree, in the name of the city, to directly pay the vendor, under each such contract of the Department in which the city participates, for the items it receives pursuant to the contract.
      (4)   The city hereby agrees to hold the Director of Transportation and the Ohio Department of Transportation harmless for any claim or dispute arising out of participation in a contract pursuant to Ohio R.C. 5513.01(B).
      (5)   The Clerk of Council is hereby authorized to forward a certified copy of this subsection to the Ohio Department of Transportation, 1980 W. Broad Street, Columbus, Ohio, 43223, requesting that this subsection be filed.
