§ 1248.16  LANDSCAPING AND ENTRANCEWAYS.
   (a)   All exposed areas within the dedicated street area shall be graded and seeded in accordance with ODOT Item 659, seeding and mulching, as amended, and according to a Landscaping Plan approved by the Planning and Zoning Commission. Street trees may be required and planted in the public street right-of-way not less than four feet from a sidewalk or curb and not less than 50 feet apart.
   (b)   Each entrance to or exit from a subdivision shall be adequately landscaped according to an approved landscaping plan that shall be clearly set forth, upon the plat. Such landscaping may include structures such as walls or fences as approved by the Planning and Zoning Commission provided the structure has a height of no more than four feet above grade. The landscaping plan, once approved, may not be modified without the prior approval of the Planning and Zoning Commission. The Planning and Zoning Commission may approve a structure with a height greater than four feet and the structure may consist of additional decorative features, including, but not limited to, railings, pillars, arches, gateways and lampposts, and other suitable architectural design features, if it finds that:
      (1)   The structure and landscaping will not interfere with traffic by impairing sight lines or otherwise unduly interfering with vehicular, bicycle or pedestrian traffic;
      (2)   The feature is part of the overall architectural theme of the entrance and does not unreasonably detract from the surrounding residential areas;
      (3)   The structure is placed upon an appropriate foundation and is composed of suitable, durable material; and
      (4)   The proper upkeep and maintenance of the structure is assured through appropriate deed restrictions, approved by the city, placing responsibility for the maintenance and upkeep upon the owners of the sublots within the subdivision that can be legally enforced by the owner or owners of sublots within the subdivision as well as the city, at the expense of the owner or owners upon the failure of the owner or owners to do so.
