§ 1248.05  MAINTENANCE OF FACILITIES BY LOT OWNERS.
   Where the subdivision contains existing approved private drives, as defined in § 1240.07 "Thoroughfare, Street or Road; Approved Private Drive," and/or drainage facilities, sewers, sewage treatment plants, water supply systems, landscaped cul-de-sacs, park areas, or other physical facilities which are necessary or desirable for the welfare of the area, and which are of common use or benefit within the subdivision and of such character that the city or other public agency does not desire or intend to maintain them, the proper and continuous maintenance and supervision of such facilities shall be jointly and collectively by the lot owners in the subdivision to the satisfaction of the City Engineer and Service Director to assure safe and appropriate ingress and egress and utilization by any emergency equipment and waste disposal vehicles. Any resubdivision of the plat will not be permitted unless brought into conformity with existing subdivision regulations approved by the city.
