(A) The city hereby adopts and implements the procedure set forth in Ohio R.C. Chapter 5722 as amended, to facilitate the effective reutilization of non-productive land situated within the boundaries of the city, to foster the return of such non-productive land to tax generating status and/or the devotion to public use which shall be known as the City of Kirtland Land Reutilization Program (the “Program”).
(B) The Clerk of Council is hereby authorized and directed, upon passage of this section, to transmit certified copies of this section to the County Auditor, the County Treasurer, and the County Prosecutor, as provided in Ohio R.C. Chapter 5722.
(C) Pursuant to the authority in Ohio R.C. Chapter 5722, the city may use the program to reutilize nonproductive land by obtaining such land through a sale pursuant to a foreclosure proceeding initiated by the Treasurer of Lake County (Ohio R.C. § 5722.03) and/or through a sale of forfeited lands by the Auditor of Lake County (Ohio R.C. § 5722.04), conveyance in lieu of foreclosure (Ohio R.C. § 5722.10) and/or any other method that may be permitted by Ohio R.C. Chapter 5722.
(D) The Mayor or his or her designee shall administer the land reutilization program in accordance with this section and Ohio R.C. § 5722.06.
(E) The city may, without competitive bidding, sell any land acquired by it as part of the program at such times, to such persons, as permitted by law and may impose redevelopment and reutilization restrictions as the city deems necessary or appropriate for the land as a condition of sale.
(F) Upon the approval of the legislative authorities of those taxing districts entitled to share in the proceeds from the sale of the land acquired by the city, as part of the program the city may either retain such land for devotion by it to public use, or sell, lease, or otherwise transfer any such land to another political subdivision for the devotion to public use by such political subdivision in accordance with Ohio R.C. § 5722.07.
(G) The proceeds of the sale of any land acquired as part of this land reutilization program shall be applied and distributed in accordance with Ohio R.C. § 5722.08.
(H) The Mayor may establish, from time to time, one or more separate neighborhood advisory committees consisting of persons living or owning property within each neighborhood affected by the program. If formed, such neighborhood advisory committees shall be operated in accordance with and pursuant to Ohio R.C. § 5722.09(B).
(I) All lands acquired and held by the city pursuant to the program, shall be deemed real property used for a public purpose and shall be exempt from taxation until sold.
(J) The city may discontinue this land reutilization program at any time in accordance with Ohio R.C. § 5722.12.
(K) The Law Director of the City of Kirtland, from time to time may, and when appropriate, make inquiry of county officials and shall participate in necessary administrative and judicial actions to obtain possession and title to such lands.
