§ 1040.03  COMPANY'S OBLIGATION TO FURNISH WATER SERVICE.
   The Ohio Water Service Company shall provide a supply of water sufficient to furnish adequate and uninterrupted public, domestic, commercial and industrial water service and water for fire protection to the city, its residents and water consumers, except only such temporary interruptions as may occur as a result of forces over which the company has no control or during the installation, repair and maintenance of waterworks and distribution facilities. The company shall maintain and repair at its own expense the mains, appurtenances and waterworks facilities in the city which are operated by the company in furnishing service under this chapter. Should the service which the company is now providing in areas adjacent to the city be taken over at any time in the future by another supplier, and if thereby it becomes impossible for the company to continue furnishing service to the city and its residents, the company shall give the city as much advance notice as possible of any such impending takeover, so that the city may make other arrangements for service to itself and its residents. Upon such takeover, the company shall be relieved of its obligation under this chapter.
