(A) This section shall apply to the construction of any driveway over any side ditch within the corporate limits of the town or over any side ditch owned by the town.
(B) Any driveway constructed over any such side ditch shall contain a metal culvert with end sections. Said culvert shall be a minimum 12 inches in diameter, be a minimum of 20 feet in length, and be laid in a position most conducive to aiding the flow of surface water.
(C) (1) Any driveway that does not comply with the requirements of this section shall be immediately removed from any such driveway by the owner thereof.
(2) However, if a majority of the Town Council determines that an emergency exist, the town may remove said driveway and assess the costs of such removal against the owner of the property involved.
