(A) Each property which receives water service from the village shall have a separate shut off box or B-Box of the brand specified by the village, which shall be located within a village public utility easement. In addition, each multi-family structure or multiple unit residential or commercial structure shall have a separate water shut off box or B-Box of the brand specified by the village which shall be located in a village public utility easement.
(B) Each building with units which do not have separate shut off boxes or B-Boxes shall have until December 1, 2009 to install the separate shut off boxes or B-Boxes at the expense of the property owner and a municipal utility easement shall be granted to the village in the form required by the village if the shut off box or B-Box is not located within an existing municipal utility easement. If a property owner fails to install the required shut off boxes or B-Boxes by December 1, 2009, the village shall provide a final notice by certified mail, return receipt requested to the last owner of record as specified in the DeKalb County tax records and a notice shall also be posted upon the front door of each unit located on the property. If the shut off boxes or B-Boxes are not installed within 21 days of the date of the notice, then the village shall have the option to shut off the water and install the shut off boxes or B-Boxes. If the village is forced to do the installation, the water shall remain shut off until the village's cost of installation, including labor and materials, is paid. Nothing herein shall prohibit the village from entering into payment plans or extending the time to install the shut off boxes or B-Boxes with property owners.
(C) Any person, firm, corporation or other business entity which fails to comply with this section by December 1, 2009, shall be subject to a fine of not less than $200 per day. Each day the offense continues shall constitute a separate offense. Upon a finding of guilty, the court shall assess a fine in an amount provided in this section and shall order the installation of the shut off boxes or B-Boxes as provided in this section. Nothing herein shall prohibit the village from seeking injunctive or other relief mandating a property owner to install a shut off box or B-Box as required herein.
