§ 52.35 PERMIT TO OPEN STREETS REQUIRED.
   (A)   No street, alley, avenue, public ground or place shall be disturbed or opened, nor shall any material, excavation, article or thing be placed or kept therein hereunder unless a permit to do so is first obtained from the Committee on Streets and Alleys. Before any permit is issued, the person desiring the same shall first file with that Committee a good and sufficient bond payable to the village with surety or sureties to be approved by the Committee, conditioned that the person shall faithfully observe the ordinances of the village and make and repair the openings and place, keep and remove the material, excavations, articles and things under the direction and to the satisfaction of the Committee, and shall save and keep harmless the village from all damages, costs, expenses and attorney’s fees arising in any manner or way from the granting of the permit or the disturbance or opening or the repairing of any such street, avenue, alley, public ground or place, or the placing, keeping, removing of any of the materials, excavations, articles or things therein. When the work is done by the village or the Superintendent, no bond shall be required. So long as the provisions of the ordinances concerning plumbers and the doing of the work by them shall remain in force and are complied with by any plumber, the plumber need not in addition comply with the provisions hereof.
   (B)   It shall be the duty of every person disturbing or opening any street, avenue, alley, public ground or place, or placing or keeping any material, excavations, articles or things therein, to do the same in such a manner as to be safe at all times to persons and property, and the person or corporation shall at all times do the work and repair the openings and disturbances in the streets, alleys, avenues, public grounds and places, and remove all the material, excavations, articles or things therefrom under the direction and to the satisfaction of the Committee on Streets and Alleys, and shall save and keep harmless the village from all damages, expenses, costs or attorneys fees that may arise in any manner or way by reason thereof. The Superintendent shall make the openings and restore the same and do the work to the satisfaction of the Committee.
