(A) Any person who is guilty of a violation of any provision of this chapter, upon conviction thereof, shall be fined not less than $10 nor more than $500 for each offense and each offense shall be deemed committed on each day during on or which a violation occurs or continues. Such fine is applicable to the person holding such permit and violating the provisions set forth herein and, further, said fine is applicable to any individual who fails to secure such a certificate prior to having said yard sale. The Kingwood Police, upon observing a yard sale occurring which does not have a certificate, shall issue a cease and stop order and force the yard sale to shut down. The violation shall be reported and hearing held at which time a fine may thereafter be issued.
(B) Should any yard sale, or the like, sign be placed on a utility pole, street light pole or on road signs, the person obtaining the certificate shall be fined $50 per sign posted in said locations.
