The terms YARD SALE, GARAGE SALE, FLEAMARKET and ISOLATED TRANSACTION as used in this chapter shall have one in the same meaning and reference and shall include any activity whereby an individual or individuals, company or corporation shall place for sale to the public in public places and on private property and not from an established business on private property miscellaneous new and used items at a monetary charge for which there is no state tax charged and for which a sale or business license has not been obtained and sales tax is not collected nor reported. Such sale is an isolated incident, not occurring on a regular or scheduled arrangement and the seller is not in the business of selling the type of tangible personal property offered for sale.
