(A) The enforcement agency of this subchapter shall consist of the Mayor, the Building Inspector and one member at large to be selected by and to serve at the will and pleasure of the Mayor. The ranking health officer and Fire Chief shall serve as ex officio members of such enforcement agency.
(B) The Building Inspector shall report his or her findings and recommendations to the enforcement agency and, if the said agency ascertains from the report and findings that the conditions of such building is such that it is an unsafe building and, therefor, a public nuisance, said enforcement agency shall forthwith direct that the owner, those in possession, and all parties in interest be notified that if such public nuisance is not abated within 30 days from the receipt of such notification, the enforcement agency shall order that such dwelling or building be declared a public nuisance and abated by demolition.
(C) Should any person, firm or corporation, disagree with or otherwise be aggrieved by an action taken or decisions made by said enforcement agency in accordance herewith, said enforcement agency shall be the presiding agency upon any verified petition filed herein.
(D) The enforcement agency, upon hearing all of the presentations of evidence upon a verified petition, shall set forth findings and conclusions in regard to said petition and shall serve an order of said findings and conclusions upon the aggrieved party immediately upon said enforcement agency arriving at a decision.
(E) Said enforcement agency shall have the final decision in regard to declaring any dwelling or building a public nuisance and ordering the abatement thereof by demolition. It shall be the duty and obligation of said enforcement agency to adhere to the rules of procedure as set forth herein.
(F) Upon the expiration of 30 days from the date of the notice to abate the public nuisance has been given to the owner, those in possession, and all parties in interest, or upon the entry of an order by said enforcement agency upon a ruling on a verified petition filed herein, said enforcement agency shall consider the question of whether such dwelling or building should be declared a public nuisance and abated by demolition. Said determination by said agency shall occur upon the majority vote of said enforcement agency and an order therefrom shall set forth the future proceedings in regard to the abatement of said public nuisance.
