§ 52.176 ENFORCEMENT OF SEWER USE RATE.
   (A)   There shall be an enforcement provision to provide for the collection of said sewer use charge by the municipality. Said enforcement shall be in the manner as provided by the State Public Service Commission for the termination of sewer service for failure to timely pay for the use.
   (B)   The municipality shall further be authorized by this subchapter to seek a judgment for any past due sewer rate charge against any person, firm or corporation who has violated any provision of this chapter. Said judgment shall be of suit filed in the Magistrate Court of the county or in other court of competent jurisdiction or in the Circuit Court of Preston County, and shall be collected in accordance with the laws of the state and the West Virginia Code, as amended, in regard to obtaining judgement and enforcement of said judgement in favor of the municipality.
