§ 53.116 HAULED WASTEWATER.
   (A)   Applicability. The city will accept septic tank waste originating from within Cleveland County, from haulers doing business in same. Septage will be accepted from haulers/pumpers who show a current licence by the NCDEHNR.
   (B)   Location and schedule. Septage will be accepted at the Pilot Creek Wastewater Treatment Plant from 9:30 a.m. until 3:00 p.m. Monday through Friday, except holidays. No loads will be received prior to the stated time. Unloading after the stated time will be by prior arrangement with the operator on duty, only. Due to flow variations, no waste will be accepted during the weeks chosen by the industries for holiday shut-down.
   (C)   Acceptable wastes. Only waste from residential type systems or portable toilets, with a pH between 6.0 and 9.0 will be accepted.
   (D)   Unacceptable wastes. No grease-trap waste, cesspool waste, sediment trap waste, industrial food processing waste, industrial oils or greases, textile waste, skimmings or sludge from treatment or pretreatment processes, nor any waste of unknown origin will be accepted.
   (E)   Access and discharge.
      (1)   Entrance to the site will be via Landfill Road. There will be one designated point for discharge of septage at the plant.
      (2)   Haulers will be responsible for the necessary means of unloading, by hose, at this point. Haulers will also be held responsible for clean-up of spills, leaks and/or repair of any damage done in the discharge or other plant area.
   (F)   Loss of privilege. The privilege of using the POTW for septage disposal shall be forfeited for any of the following reasons:
      (1)   Failure to pay charges and/or fees promptly;
      (2)   Falsification of documents;
      (3)   Failure to abide by regulations;
      (4)   Unloading of any waste prohibited by ordinance;
      (5)   Unloading of waste in violation of CCHD regulations;
      (6)   Interference with the duties of plant personnel; and
      (7)   Failure to maintain current approval forms.
   (G)   Disclaimer. The city will not be responsible for actions of haulers or their employees, damage done to haulers equipment while on city property, nor verbal commitments by city employees. The hauler’s decision to use this means of disposal shall indicate his or her acceptance of all conditions as set forth.
   (H)   Discontinuance. Should the acceptance of septage create problems with the ability of the POTW to meet the limits of its NPDES permit, present or future; or cause operational problems or expenses not recoverable from hauler fees, the Director may, at any time, end the acceptance of septage.
