§ 116.053 GROUNDS FOR REVOCATION; ACTS OF DRIVERS.
   (A)   The City Council or designee may revoke or refuse to renew a driver’s permit if the person to whom the driver’s permit was issued is, at any time after issuance:
      (1)   Found to have committed, been convicted of or pled guilty or no contest to any of the following:
         (a)   A violation of any federal, state or local law relating to the use, possession, manufacture or sale of alcoholic beverages or any substance regulated by the State Controlled Substances Act (G.S. §§ 90-86 through 90-113.8) or the State Toxic Vapors Act (G.S. §§ 90-113.8A through 90-113.14);
         (b)   A violation of any federal, state or local law relating to prostitution or gambling;
         (c)   A suspension or revocation of one’s driver’s licenses;
         (d)   Any felony;
         (e)   Any violation of a federal, state or local law designed for the protection of life; and/or
         (f)   Any criminal assault involving the operation of a taxicab.
      (2)   Found to have made or caused to be made a false statement in his or her application for issuance or renewal of a driver’s permit; and/or
      (3)   Does not continue to meet the qualifications for a driver’s permit set forth in § 116.047.

   (B)   Upon a determination by the City Council or designee that a driver has committed, been convicted of or pled guilty or no contest to:
      (1)   Any of the offenses specified in division (A) above;
      (2)   A violation of any provision of this chapter pertaining to the operation of taxicabs; or
      (3)   A violation of any federal, state or local law pertaining to the public health or morals;
and that the offense or violation occurred while the driver was engaged in the operation of a taxicab or was engaged in some act related to the operation of a taxicab, the City Council shall give notice of the determination to the driver and to the operating permit holder under which the driver was operating.
