§ 97.12 VEHICLES TRANSPORTING LOOSE MATERIALS; COVER REQUIRED.
   (A)   It shall be unlawful for a responsible person, as described in this chapter, to operate a vehicle transporting loose materials within the city without a suitable cover. This section shall not apply to the transportation of poultry or livestock, or silage or other feed grain used in the feeding of poultry or livestock, these being the only allowed exception. Any other responsible person arriving at the city landfill and operating an uncovered vehicle in violation of the above shall be allowed access to the landfill only after being issued a first notice of violation. All violations of this section following the first shall be subject to a citation to be issued by the Police Department.

   (B)   Any person collecting and transporting solid waste generated on his or her own property for disposal at an approved disposal site shall be required to comply with this division (B). In addition, any person hauling solid waste must specifically comply with the following:
      (1)   Spillage prohibited. The vehicles or containers used for the collection and transportation of solid waste, shall be loaded and removed in a manner that the contents will not fall, leak or spill from the vehicles or containers. Materials spilled by any person shall be picked up immediately by the person and returned to the vehicle or container and the area properly cleaned.
      (2)   Cover requirements.
         (a)   Vehicles shall be covered by effective means during transportation to prevent blowing of materials from the vehicle.
         (b)   EFFECTIVE MEANS shall include, but not be limited to, durable heavy plastic or canvas, tied down or secured to cover all the load. Loads consisting of bulky waste, white goods, lumber, pallets and crates do not have to be covered, but shall be secured with rope or tie-downs to assure spillage does not occur.
         (c)   Upon entrance into any designated facility gate, any removal of covers on solid waste shall be prohibited until the destination in the designated facility disposal area is reached.
      (3)   Enforcement. In addition to those who are authorized under the code of ordinances for the city for enforcement of ordinances as to collection and disposal of solid waste; those who are authorized as enforcement officers for Cleveland County shall also have jurisdiction for the enforcement of this division (B) within the jurisdiction of the city.
