§ 90.044 STREET SURFACING AND RESURFACING.
   (A)   The city may surface, upon receipt and approval by the City Council of a valid petition, any unpaved street in the city where there exists a public street right-of-way. The city will pay 50% of the total cost. The benefitted property owners shall pay 50% of the actual cost. This section covers only assessments for unpaved streets that existed prior to 7-1-2001.
   (B)   Only those streets on the system which have been accepted by the City Council shall be resurfaced from time to time by the city. The City Council shall set priorities annually for the streets to be resurfaced, after recommendations have been received from the Public Works Director. All utility taps should be made prior to paving or surfacing.
