Any water well use or maintained for domestic use contrary to the provisions of this article constitutes a common nuisance, and each day that the same is so maintained and used shall constitute a separate offense, and any person, either as owner, proprietor, operator, agent or employee, who shall so maintain or use the well, or permit the use thereof shall be guilty of a misdemeanor.
