§ 13-110 OBSTRUCTING SIDEWALKS.
   (a)   Generally. It shall be unlawful for any person to build or construct any step or other obstruction, whether temporary or permanent, or to store, leave or allow to be left any implements, tools, merchandise, goods, containers, benches, display or show cases, on any sidewalks or other public ways in the city or to obstruct the same longer than is necessary for loading or unloading any such article or object.
   (b)   Exception. Businesses serving food and/or beverages may obtain a special use permit approved by the governing body to allow for the placement of tables and chairs in front of the building; provided, that the following is provided and approved:
      (1)   Written plan detailing the layout of the table and chairs (must be “period” design if left out overnight and approved by the Downtown Redevelopment Board), rails or barriers (if deemed necessary);
      (2)   Allow six feet minimum unobstructed sidewalk;
      (3)   Five-hundred thousand dollar liability insurance with the city listed as additional insured;
      (4)   Conform with zoning regulations; and
      (5)   Twenty-five dollar annual fee, valid from January 1 to December 31 each year.
