§ 7-204 OPEN BURNING.
   Open fires or open burning within the corporate limits of the city shall be unlawful, except as set forth herein in this section as follows.
   (a)   The building of open fires, if for cooking or ceremonial purposes, on public or private lands regularly used for recreation purposes, shall be allowed without the necessity of a burning permit.
   (b)   Open burning operations shall be allowed with a burning permit approved by the Code Enforcement Officer, Fire Chief or his or her designee. A burning permit application shall be required, and the applicant must demonstrate that such open burning is necessary and in the public interest. If approved, the burning permit shall be effective for a specified period of time and such burning permit may require such special conditions as the Code Enforcement Officer, Fire Chief or his or her designee may deem necessary to prevent contaminant emissions which are, or tend to be, injurious to human health, animal or plant life, or property, or capable of unreasonably interfering with the enjoyment of life or property. Such approval shall be revocable upon notification from the Code Enforcement Officer, Fire Chief, or his or her designee. The burn permit fee shall be as approved by the governing body and listed in the latest City of Kingman Schedule of Fees.
