All such structures as designated in this article conform as to location, specifications and requirements of this article shall be made to so conform within 90 days; provided, that any such structures now supported solely from the building or by a post or other structure located entirely upon private property, and no part thereof below seven feet above the sidewalk or grade level, may be allowed to remain and be used as the same are now constructed until and unless the same shall need material repair or reconstruction, or are changed in type, in which event, the same shall be constructed to meet the requirements as set out in this article, or any amendment thereof; provided further, that by resolution of the governing body, any such structures that do not conform to the requirements of this article, or any amendments thereof, may be ordered to be made to so conform. Notice of the enactment of such resolution shall be served, in writing, upon the owner or operator of the premises where such structure is to be altered, and such structure shall be made to so conform within not to exceed 60 days from the service of the notice.
