11-7-3: LOT, YARD AND HEIGHT REGULATIONS:
No lot or yard shall be established or reduced in dimension or area in any residential district that does not meet the minimum requirements set forth in this section. No building or structure shall be erected or enlarged that will cause maximum lot coverage or maximum height regulations to be exceeded for such district as set forth in the following subsections:
   A.   Area And Height Regulations For R-1 Single-Family Districts:

All lots and improvements within the R-1 district shall meet the following requirements:
      1.   All lots shall have not less than four thousand five hundred (4,500) square feet of lot area, and not more than one principal building shall be placed on any one lot.
      2.   Each lot shall have a frontage of not less than fifty feet (50'). The frontage of any wedge shaped lot which meets the requirements of minimum lot size may be a minimum of thirty five feet (35'), provided the front building line on the lot shall be a minimum of fifty (50) linear feet measured at an equal distance parallel to and from the front lot line.
      3.   Not more than thirty percent (30%) of the lot area shall be covered with improvements. Paved areas are not considered improvements within the meaning of this provision.
      4.   No improvement or structure shall exceed thirty five feet (35') in height above the mean elevation of the lot.
      5.   All structures shall have not less than a twenty five foot (25') front yard setback.
      6.   For a single-family dwelling of one story, the minimum width of the side yard shall be five feet (5') for interior lot lines and twenty five feet (25') for the side yard abutting the side street on a corner lot. For buildings of more than one story, the minimum width of the side yard on interior lot lines shall be five feet (5').
      7.   A rear yard of twenty percent (20%) of the depth of the lot shall be provided for the principal building. Unattached buildings of accessory use may be located in the rear yard of a main building; provided, however, that no accessory building shall be located closer than ten feet (10') to the rear lot line.    B.   Area And Height Regulations For R-1 ZL Single-Family Zero Lot Line District: Property and buildings in the R-1 ZL district shall be subject to the following area regulations:

All uses and buildings other than single-family dwellings shall be subject to the area regulations of the R-1 district.
      1.   Lot Area: There shall be a minimum lot area of not less than four thousand five hundred (4,500) square feet.
      2.   Coverage: Main and accessory buildings shall not cover more than fifty percent (50%) of the area of the lot. Accessory buildings shall not cover more than twenty percent (20%) of the rear yard.
      3.   Height Regulations:
         a.   No dwelling structure in the R-1 ZL district shall exceed two and one-half (21/2) stories or thirty five feet (35') in height.
         b.   No accessory building in the R-1 ZL district shall exceed one story or fifteen feet (15') in height.
      4.   Single-Family Dwellings:
         a.   Front Yards:
            (1)   The minimum depth of the front yard shall be twenty feet (20').
         b.   Side Yards:
            (1)   For attached dwellings, a zero side yard is allowed along a common when both units (structures) are built at the same time, provided that the remaining side yard is five feet (5') or greater.
            (2)   For unattached dwellings, including garages, one side yard may be reduced to zero provided:
               (A) A two and one-half foot (21/2') minimum maintenance and open space easement is secured on the lot adjoining the reduced side yard.
               (B) The remaining side yard is not less than five feet (5'), and is perpetually maintained free and clear from any obstructions.
               (C) The wall located on the zero side yard is constructed of maintenance free masonry and has no window or door openings, or mechanical equipment exhaust/vent terminations.
               (D) No portion of the dwelling or architectural features, including eave overhangs, projects over any property line.
               (E) The zero side yard is not adjacent to a public or private right of way.
            (3)   For all other unattached dwellings, side yard setbacks shall be the same as the R-1 district.
            (4)   On any corner lot, a building shall be set back from the right of way line of the intersecting street a distance of fifteen feet (15') in the event such lot is back to back with another corner lot, and twenty feet (20') in every other case.
            (5)   In no case shall a garage which opens onto a street be located closer than twenty feet (20') to that street property line.
         c.   Rear Yards: There shall be a rear yard of not less than fifteen feet (15').
      5.   Lot Width: There shall be a minimum lot width of not less than forty five feet (45') for unattached single-family dwellings and forty feet (40') for attached single-family dwellings. No lot shall abut a street for a distance of less than thirty five feet (35').
      6.   Accessory Buildings, Other Than Garages: Unattached one story buildings of accessory use shall be set back a minimum of five feet (5') from any interior side lot line, utility easement, or rear property line. (Ord. 813, 12-5-1995)

      1.   All lots shall have not less than four thousand five hundred (4,500) square feet for single-family dwellings and not less than ten thousand five hundred (10,500) square feet for two-family dwellings and other uses, and not more than one principal building shall be placed on any one lot, except as otherwise specified.
      2.   Each lot shall have a frontage of not less than fifty feet (50') for single-family dwellings and seventy five feet (75') for two-family dwellings and all other uses. The frontage of any wedge shaped lot may be a minimum of thirty five feet (35'), provided the width of the lot at the front building line on the lot shall be not less than that specified above.
      3.   Not more than thirty five percent (35%) of the lot area shall be covered with improvements. Paved areas are not considered improvements within the meaning of this provision.
      4.   No improvement or structure shall exceed thirty five feet (35') in height above the mean elevation of the lot without the approval of the board of adjustment.
      5.   All structures shall have not less than a twenty five foot (25') front yard setback.
      6.   For a single- or two-family dwelling of one story, the minimum width of the side yard shall be five feet (5') for interior lot lines and twenty five feet (25') for the side yard abutting the side street on a corner lot. For buildings of more than one story, the minimum width of the side yard on interior lot lines shall be five feet (5').
      7.   A rear yard of twenty percent (20%) of the depth of the lot shall be provided for the principal building. Unattached buildings of accessory use may be located in the rear yard of a main building; provided, however, that no accessory building shall be located closer than ten feet (10') to the rear lot line.
   D.   Area And Height Regulations For R-3 Multi-Family Districts:

All lots and improvements within the R-3 multi-family residential districts shall meet the following requirements:
      1.   Each lot shall have a frontage of not less than seventy five feet (75') for two-family dwellings, and one hundred feet (100') for multi-family dwellings and all other uses. The frontage of any wedge shaped lot may be a minimum of thirty five feet (35'), provided the width of the lot at the front building line shall be not less than that specified hereinabove.
      2.   Not more than fifty percent (50%) of the lot area shall be covered with improvements, except that a duplex shall not exceed thirty five percent (35%) coverage. Paved areas are not considered improvements within the meaning of this provision.
      3.   No improvement or structure shall exceed thirty five feet (35') in height above the mean elevation of the lot.
      4.   A minimum front yard setback of twenty five feet (25') shall be provided on all duplex and multi-family dwellings.
      5.   For duplex and multi-family dwellings, the minimum side yard setback shall be five feet (5'). For dwellings and accessory buildings located on corner lots, the side yard setback from the intersecting street shall be twenty five feet (25').
      6.   A rear yard of twenty percent (20%) of the depth of the lot shall be provided for the principal building. Unattached buildings of accessory use may be located in the rear yard of a main building; provided, however, that no accessory building shall be located closer than ten feet (10') to the rear lot line.
