9-4-7: HAULING OR DEPOSITING OF GARBAGE; PERMIT; PROHIBITED ACTS:
   A.   Permit Required For Hauling Or Depositing:
      1.   No person shall, without first securing a written permit from the City, dump or deposit any manure, garbage, litter, offal matter, rubbish, debris, trash, junk, refuse or similar material on any public or private property for the purpose either of filling low ground or disposing of the materials, or for any purpose whatsoever.
      2.   Nothing in this subsection shall prohibit the otherwise lawful hauling and dumping of dirt, sand, rock and gravel for landfill purposes.
   B.   Dumping On Property Of Another: It shall be unlawful for any person to dump, deposit, throw or in any manner leave or abandon any garbage, litter, offal matter, rubbish, debris, trash, junk, refuse or similar material on any property owned or occupied by another person without the written permission of the owner or occupant of such property.
   C.   Violation; Prima Facie Proof, Registered Owner: In any prosecution charging a violation of this section, proof that the particular vehicle described in the complaint or citation was used for the purpose of unlawfully hauling or dumping of material as prohibited therein together with proof that the individual named in the complaint or citation was at the time of the violation the registered owner of said vehicle shall constitute in evidence a prima facie presumption that the registered owner of said vehicle was the person who committed the violation.
   D.   Proof Of Person Committing Unlawful Disposal Of Materials: In any prosecution charging a violation of this section, proof that unlawfully disposed of material as described therein which contains three (3) or more items bearing a common address in a form which tends to identify the latest owner of the items shall be prima facie presumption that all competent persons residing at such address committed the unlawful act of disposal; provided, that one of the said items of solid waste bears a date subsequent to the effective date hereof.
