The various solid waste collection rates shall be in such amounts as set by the board of commissioners as provided in the fines and fees schedule in appendix A, division IV of this Code. The rates set by the board of commissioners shall be allowed to be adjusted annually without a vote of the board of commissioners if and only if the adjustment is being made to offset a consumer price index adjustment made by the city’s service provider. If, in the sole discretion of the city manager a rate adjustment is not necessary during a given year, the adjustment may be delayed for one year, meaning that an adjustment may be made to account for up to two (2) years’ worth of consumer price index increases in one calendar year, if and only if the previous calendar year’s adjustment was delayed. In the event that a consumer price index increase is delayed for more than one year, a vote of the board of commissioners would be required to make the adjustment. (2013 Code; amd.
