9-3-6: INDUSTRIAL USERS:
   A.   Definitions:
      1.   Terms Defined: As used in this section, the following terms shall have the meanings ascribed to them in this subsection:
    CITY: The city of Kingfisher, Oklahoma.
   SEWERAGE SYSTEM: The sanitary sewerage system that is operated by the city or by any trust or entity for the city.
      2.   Abbreviations: As used in this section, the following abbreviations shall have the meanings ascribed to them in this subsection:
    BOD: Biochemical oxygen demand, as that term is employed by sanitary sewer engineers, and shall be determined by a five (5) day test of composite sampling at a temperature of twenty degrees centigrade (20oC).
   IC: A charge in terms of dollars that is assessed or taxed against industries using or connected to the sewer system.
   SS: Suspended solids of industrial waste in a composite sampling.
   V: The volume of flow of industrial waste in units of seven hundred fifty (750) gallons.
   B.   Industrial User Charge: Each industrial user connected to, or using, the sewerage system mentioned in this section shall pay to the city or to the entity operating the said sewer system, in addition to other charges properly made, a monthly charge, designated as IC, which is in terms of dollars and shall be computed by the following formula:
      IC equals 0.07V plus 0.04(BOD) plus 0.02(SS)
   C.   Industrial User Requirements: In addition to the user charge in subsection B of this section, each industrial user which contributed thirty percent (30%) or more of the total volume of the municipally treated wastes shall make substantial prepayment for capital investments required to treat the wastes. The amount of such payment to be required from such industrial user shall be determined by the board of city commissioners at a hearing on the matter, of which hearing the industrial user shall have been given at least five (5) days' written notice. The industrial user shall have the right to be present at the hearing and to be represented by counsel and to present evidence pertaining to the matter that is to be determined.
   D.   Discharge Of Wastes: No user of the city sewerage system shall discharge waste into such sewerage system containing the following named substances in greater quantities or amounts measured in parts per million (ppm) than the ppm hereinafter shown opposite the name of each of such substance:

   E.   Discharge Requirements: Users of the sewerage system shall limit the discharge of industrial waste into such system to levels that will not adversely affect the operation of the system or the waste treatment facilities and will meet current and future state water quality standards applicable to the city. To comply with this provision, the city may require the user to pretreat the industrial waste before discharging it into the sewerage system.
   F.   Authority Regarding Violations: As to any industrial user violating the provisions of this section, the city or the public works authority operating the sewerage system may disconnect the user's facility or plant from the sewerage system. Alternatively, the city or public works authority may apply to the proper court of the state for an injunction to prohibit such violation. (2013 Code)
