8-5-4: ZONING OVERLAY DISTRICT:
   A.   District Established; Restrictions:
      1.   District Established: A Kingfisher Municipal Airport zoning district is hereby established pursuant to the authority conferred by 3 Oklahoma Statutes sections 100 through 116, as amended.
      2.   Restrictions: The airport zoning district is a superimposition district within the A-agricultural district; and relates only to the municipal airport uses. Restrictions are as follows:
         a.   No obstruction that may have potential for endangering the lives and property of users of the Kingfisher Municipal Airport shall be permitted.
         b.   No obstruction shall be allowed which may affect existing and future instrument approaches.
         c.   No obstruction shall be permitted which may reduce the size of areas available for the landing, takeoff, and maneuvering of aircraft, or that may tend to destroy or impair the utility of the Kingfisher Municipal Airport.
         d.   The prevention of obstructions shall be accomplished, to the extent of legal action possible, by the exercise of the police power without compensation.
   B.   Official Airport Zoning Overlay Map:
      1.   In order to carry out the provisions of these airport zoning overlay district regulations, there are hereby created and established certain zones which include all of the land lying beneath the approach surfaces, transitional surfaces, horizontal surfaces and conical surfaces as they apply to the Kingfisher Municipal Airport. Such zones as shown on the official airport zoning overlay map of the city are hereby incorporated as if included within these airport zoning overlay district regulations.
      2.   An area located in more than one of the following zones is considered to be only in the zone with the more restrictive height limitation. The various zones are hereby established and defined as follows:
         a.   Utility Runway Visual Approach Zone: The inner edge of this approach zone coincides with the width of the primary surface and is two hundred fifty feet (250') wide. The approach zone expands outward uniformly to a width of one thousand two hundred fifty feet (1,250') at a horizontal distance of five thousand feet (5,000') from the primary surface. Its centerline is the continuation of the centerline of the runway.
         b.   Utility Runway Nonprecision Instrument Approach Zone: The inner edge of this approach zone coincides with the width of the primary surface and is five hundred feet (500') wide. The approach zone expands outward uniformly to a width of two thousand feet (2,000') at a horizontal distance five thousand feet (5,000') from the primary surface. Its centerline is the continuation of the centerline of the runway.
         c.   Transitional Zones: Transitional zones are the areas beneath the transitional surfaces.
         d.   Horizontal Zone: The horizontal zone is established by swinging arcs of five thousand feet (5,000') radii from the center of each end of the primary surface of each runway and connecting the adjacent arcs by drawing lines tangent to those arcs. The horizontal zone does not include the approach and transitional zones.
         e.   Conical Zone: The conical zone is established as the area that commences at the periphery of the horizontal zone and extends outward therefrom a horizontal distance of four thousand feet (4,000').
   C.   Height Limitations: Except as otherwise provided in these airport zoning overlay district regulations, no structure shall be erected, altered, or maintained, and no tree shall be allowed to grow in any zone created by these airport zoning overlay district regulations to a height in excess of the applicable height limit herein established for such zone. Such applicable height limitations are hereby established for each of the zones in question as follows:
      1.   Utility Runway Visual Approach Zones: Slopes twenty feet (20') outward for each foot upward beginning at the end of and at the same elevation as the primary surface and extending to a horizontal distance of five thousand feet (5,000') along the extended runway centerline.
      2.   Utility Runway Nonprecision Instrument Approach Zones: Slopes twenty feet (20') outward for each foot upward beginning at the end of and at the same elevation as the primary surface and extending to a horizontal distance of five thousand feet (5,000') along the extended runway centerline.
      3.   Transitional Zones: Slopes seven feet (7') outward for each foot upward beginning at the sides of and at the same elevation as the primary surface and the approach surface, and extending to a height of one hundred fifty feet (150') above the airport elevation which is one thousand two hundred eighteen feet (1,218') above mean sea level. In addition to the foregoing, there are established height limits sloping seven feet (7') outward for each foot upward beginning at the sides of and at the same elevation as the approach surface, and extending to where they intersect at the conical surface.
      4.   Horizontal Zones: Established at one hundred fifty feet (150') above the airport elevation.
      5.   Conical Zones: Slopes twenty feet (20') outward for each foot upward beginning at the periphery of the horizontal zone and at one hundred fifty feet (150') (elevation above the airport elevation of 1,218 feet) and extending to a height of three hundred fifty feet (350') above the airport elevation (elevation 1,418 feet).
      6.   Expected Height Limitations: Nothing in these airport zoning overlay district regulations shall be construed as prohibiting the construction or maintenance of any structure, or the growth of any tree to a height of fifty feet (50') above the surface of the land.
   D.   Additional Use Restrictions: Notwithstanding any other provisions of these airport zoning overlay district regulations, no use may be made of land or water within any zone established by these airport zoning overlay district regulations in such a manner as to create electrical interference with navigational signals or radio communication between the airport and aircraft, make it difficult for pilots to distinguish between airport lights and others, result in glare in the eyes of pilots using the airport, impair visibility in the vicinity of the airport, create bird strike hazards, or otherwise in any way endanger or interfere with the landing, takeoff, or maneuvering of aircraft intending to use the airport.
   E.   Nonconforming Uses:
      1.   Regulations Not Retroactive: The requirements prescribed by these airport zoning overlay district regulations shall not be construed to require the removal, lowering, or other change or alteration of any structure or tree not conforming to the regulations as of the effective date hereof, or otherwise interfere with the continuance of a nonconforming use. Nothing contained herein shall require any change in the construction, alteration, or intended use of any structure, the construction or alteration of which was begun prior to the effective date hereof, and is diligently prosecuted.
      2.   Marking And Lighting: The owner of any existing nonconforming structure or tree is hereby required to permit the installation, operation, and maintenance thereon of such markers and lights as shall be deemed necessary by the Kingfisher planning and zoning commission, to indicate to the operators of aircraft in the vicinity of the airport the presence of such airport obstructions. Such markers and lights shall be installed, operated, and maintained at the expense of the city. (2013 Code)
