A. Retail sales of fireworks within the municipal boundaries of the City of Kingfisher shall be allowed by permit only. Permits will only be issued if the following conditions are met:
1. The retail sales will comply with 68 0.S. § 1623 (regarding the conditions for storage, sale, and use of fireworks), as may be amended from time to time.
2. The retail sales will be conducted by the holder of a valid Oklahoma Tax Commission Sales Tax Identification Number and all sales taxes are collected and paid as required by law.
3. A permit fee is paid in an amount set by the board of commissioners as provided in the fines and fees schedule pursuant to appendix A, division IV of this code.
B. Retail sales permits may be revoked for violations of any of the provisions of this chapter or with or without notice in the event that the City deems that external factors, including but not limited to weather conditions, create an increased risk to life and property. In the event that a permit is revoked, all fireworks must be removed from the site or shall be properly stored to avoid danger to the public. (Ord. 2021-003, 4-12-2021)
