11.10.275   Reckless operations.
It is unlawful for any boat owner using the boat harbor to operate or cause to be operated a boat in a reckless manner. For the purpose of this section "to operate in a reckless manner" means to operate a boat in willful or wanton disregard of the rights or safety of others, or without due caution and circumspection, or at a speed or in a manner as to endanger or to be likely to endanger a person or property, or that which creates a substantial and unjustifiable risk of harm to person or property. A substantial and unjustifiable risk is a risk of such a nature and degree that the conscious disregard of it or a failure to perceive it constitutes a gross deviation from the standard of conduct that a reasonable person would observe in a situation.
