5.40.116   Determination of rate of levy.
   A.   The city council will by ordinance annually determine the rate of levy, expressed in terms of dollars or cents per pound of fisheries resources processed.
   B.   If the ordinance fixing the annual rate of levy is enacted before the last day of February, the rate of levy will be effective as of January 1 for that entire calendar year. If the ordinance fixing the annual rate of levy is enacted on or after March 1, the new rate of levy will be effective commencing on the first day of the month following the month in which the ordinance is enacted, and the preceding year’s annual rate of levy will continue in effect prior to that date.
   C.   If the city council does not enact the ordinance determining the annual rate of levy prior to January 1, the rate of levy for the preceding calendar year shall be used by the taxpayer for the purpose of filing monthly tax returns and paying taxes owed before the new annual rate of levy is fixed. Appropriate amended returns must be filed to reflect any changes in the tax owed if the annual rate of levy is fixed after the taxpayer has filed one or more returns and paid taxes based on the preceding year’s rate of levy.
