(A) Designated fishing zones shall be marked. The owners of oceanfront fishing piers shall mark and maintain or cause to be marked and maintained a zone formed by parallel lines extending 75 yards in width from either side of the centerline of the eastward extension of any fishing pier in and over the water of the Atlantic Ocean abutting and contiguous to the town. The zone shall be marked at its easternmost terminus by buoys or other flotation markers or devices located at the northeast and southeast comers of the zone. The northwest and southwest corners shall be marked in a manner as to be visible from the surface of the water at the northeast and southeast corners of the zone. The corner markers need not be maintained during periods in which the responsible oceanfront pier has closed and is not open for commercial activity.
(B) No person shall surf, swim or float upon a surfboard or other flotation device in the zone formed by parallel lines extending 75 yards in width from either side of the centerline of the eastward extension of any fishing pier in and over the waters of the Atlantic Ocean abutting and contiguous to the town and marked at the zone's easternmost terminus by buoys or other flotation markers or devices located at the northeast and southeast comers of the zone, which areas have been marked in accordance with the provisions of division (A) of this section.
(C) Surf-fishing, spear fishing within 75 yards of any fishing pier. No person shall surf-fish or spear fish or swim with a spear fishing gun in the zone formed by parallel lines extending 75 yards in width from either side of the centerline of the eastward extension of any fishing pier in and over the waters of the Atlantic Ocean abutting and contiguous to the town and marked at the zone's easternmost terminus by buoys or other flotation markers or devices located at the northeast and southeast corners of the zone, which areas have been marked in accordance with the provisions of division (A) of this section.
