§ 51.38 BILLING DATE; PAST DUE DATE; PENALTY FOR LATE PAYMENT; PENALTY FOR RETURNED CHECK; DISCONNECTION OF SERVICE FOR NONPAYMENT.
   (A)   In the event that utilities service is disconnected because of the failure of the owner to comply with any of the provisions of this section, the fee for reconnection of utilities service shall be that as adopted and amended from time to time by the Board of Commissioners and on file with the Town Clerk.
   (B)   Unpaid utilities bills become delinquent 30 days from the date mailed and are subject to a late charge penalty of 10%.
   (C)   There shall be a penalty, as determined from time to time by the Board of Commissioners, for any check used to pay a utilities bill or statement which is not accepted for any reason by the bank upon which it is drawn.
   (D)   If a utilities bill or statement is not paid on or before the first day of the seventh week following the original mailing date of the unpaid statement or bill, the utilities service shall be cut off and terminated.
   (E)   An administrative service penalty, as determined from time to time by the Board of Commissioners, shall be charged for any service that is not paid on or before the first day of the seventh week following the original date of the unpaid statement or bill as set forth on the utilities bill or statement.
   (F)   When a water service is terminated for nonpayment as described in this section for a period of two quarters, no further bills shall be sent. When a meter has been removed and/or disconnected and remains inactive for an additional period of 18 months or six quarters, the service shall be removed and the account deemed “VOID.” All fees shall be taken off the books and the accounting stopped. The account shall cease to exist. In order for service to be reactivated, all fees, tap fees, system development fees and surety deposit will be required. Credit will be given for payment of previous system development fees, up to but not exceeding the amount of the current system development fee.
