Any person owning or having charge of land within the municipality who fails to take action as described under § 174.16 is guilty of a minor misdemeanor and shall be subject to a mandatory nonsuspendable fine of $150. It shall be an affirmative defense to a charge under this section that the person charged was prevented from taking such action due to inclement weather.
