A. Offense Committed: A driver or operator of a motor vehicle other than an authorized emergency vehicle, commits the offense of aggressive driving when, in the course of operating a motor vehicle upon a street or highway, that driver's actions include at least three (3) of the following driving behaviors, either singly, or in combination:
1. Rapid acceleration.
2. Rapid braking.
3. Squealing tires as defined in 625 Illinois Compiled Statutes 5/11-505.
4. Improper overtaking on right as defined in 625 Illinois Compiled Statutes 5/11-704.
5. Improper overtaking on left as defined in 625 Illinois Compiled Statutes 5/11-703 or 5/11-705.
6. Following too closely as defined in 625 Illinois Compiled Statutes 5/11-710.
7. Excessive speed as defined in 625 Illinois Compiled Statutes 5/11-601.
8. Two (2) or more successive lane changes within one thousand feet (1,000').
9. Improper lane usage as defined in 625 Illinois Compiled Statutes 5/11-700 et al.
10. Sounding the horn as defined in 625 Illinois Compiled Statutes 5/12-601.
11. Flashing the headlights as defined in 625 Illinois Compiled Statutes 5/12-212.
B. Penalty:
1. Any person convicted of a violation of this section shall be fined not less than five hundred dollars ($500.00).
2. Any person convicted of a violation of this section, where such driving actions resulted in property damage shall be fined not less than one thousand dollars ($1,000.00).
3. Any person convicted of a violation of this section, where such driving actions resulted in bodily injury to any individual shall be fined not less than two thousand dollars ($2,000.00). (Ord. 03-O-886, 11-3-2003)
