The owner of a nondirect alarm system, which has more than two (2) false alarms in a calendar year, may avoid prosecution for violating this chapter as follows: (Ord. 04-O-889, 1-6-2004)
A. Within five (5) days from the issuance of a notice of violation, excluding Saturdays, Sundays, and holidays, by paying to the village in care of the police clerk at 21911 Quentin Road, Kildeer, Illinois, the sum of fifty dollars ($50.00) for each violation if the notice is for a third and/or fourth false alarm in any calendar year, and the sum of fifty dollars ($50.00) for each violation if the notice is for a fifth through tenth false alarm in the same calendar year, and the sum of one hundred dollars ($100.00) for each violation if the notice is for the eleventh violation or more.
B. Within fifteen (15) days from the issuance of a notice of violation, excluding Saturdays, Sundays, and holidays, by paying to the village in care of the police clerk at 21911 Quentin Road, Kildeer, Illinois, the sum of one hundred dollars ($100.00) for each violation if the notice is for a third and/or fourth false alarm in any calendar year, and the sum of one hundred dollars ($100.00) for each violation if the notice is for a fifth through tenth false alarm in the same calendar year, and the sum of one hundred fifty dollars ($150.00) for each violation if the notice is for the eleventh violation or more.
C. Within twenty five (25) days from the issuance of a notice of violation, excluding Saturdays, Sundays, and holidays, by paying to the village in care of the police clerk at 21911 Quentin Road, Kildeer, Illinois, the sum of one hundred fifty dollars ($150.00) for each violation if the notice is for a third and/or fourth false alarm in any calendar year, and the sum of one hundred fifty dollars ($150.00) for each violation if the notice is for a fifth through tenth false alarm in the same calendar year, and the sum of two hundred fifty dollars ($250.00) for each violation if the notice is for the eleventh violation or more. In the event that the owner of the nondirect alarm system does not pay the required sum within the initial five (5) day period, as hereabove provided, the police clerk shall send notice that the fine has not been received within the prescribed five (5) day period, and that, therefore, the fine has escalated as described above, which must be paid to avoid prosecution within thirty (30) days of said notice. All remittances of fines as provided herein may be made by check, money order, cash, or cashier's check, and must be accompanied by a signed plea of guilty and a waiver of hearing.
