8-10-2: LOCAL BURNING RESTRICTIONS:
   A.   Open Burning Prohibited:
      1.   Defined: "Open burning" is defined as the burning of any materials where smoke and fumes are emitted directly into the air without passing through a chimney or duct. It shall be unlawful to burn paper, wood, garbage, leaves, landscape debris, building construction or demolition debris, or any other combustible material in open fires or in metal containers, except as provided below.
      2.   Exceptions:
         a.   Exceptions that do not require a permit/permission are limited to: fireplaces, bonfires or recreational fires with specific restrictions, open flame cooking devices such as cookers, barbecues, and outdoor warming stoves such as chimeneas. Such burning shall use only seasoned firewood, charcoal, natural gas, or LPG gas and shall not extend outside of the fire pit, fireplace or open flame cooking device. Recreational fires, bonfires and fire pits shall be limited in size to three feet (3') in diameter and two feet (2') in height. Open flame cooking devices shall be a manufactured cooking device used for the preparation of food. Outdoor fireplaces, chimeneas and/or fire pits shall be a manufactured container or structure that holds fire at the base of a chimney or hearth, is constructed of stone, brick, steel or other noncombustible materials, and is provided with a screen or a spark arrestor above the fire.          b.   Exception for open burning of landscape debris only (excluding leaves and grass clippings) requires a permit/permission for: 1) wooded residential lots of one (1) acre or more, 2) recognized range management, or 3) wildlife management practices. Excepted burning shall be limited to the dates of April 15 through May 30 and October 15 through November 30, from seven o'clock (7:00) A.M. to dusk. These exceptions require notification/permission from the Village. Application should be made in advance during working hours at the Village Hall. The Village of Kildeer may prohibit or order the extinguishment of any open burning which creates or adds to a hazardous or objectionable situation.
         c.   Guidelines for exceptions:
            (1)   Open burning shall be constantly attended by an adult of eighteen (18) years of age or older, until the fire is extinguished.
            (2)   A fire extinguisher, water supply, or other extinguishing material must be available.
            (3)   Open burning shall not be permitted less than fifty feet (50') from any structure or overhang (including houses, sheds, trees, power lines, trellises, balconies or decks), except for open flame cooking devices.
            (4)   Burning is prohibited when wind speed exceeds twenty (20) miles per hour.
Additional safety guidelines are available through the appropriate rural fire protection district. In general, the fire district boundary line runs perpendicular to South Krueger Road and on a visually straight line from East Cuba Road south to Rand Road. The area west of these boundary lines are served by the Lake Zurich Rural Fire Protection District which should be contacted at (847)540-5073.    B.   Penalty: Any person violating this section shall be fined one hundred dollars ($100.00) for the first offense, three hundred dollars ($300.00) for the second offense, and five hundred dollars ($500.00) for every subsequent offense. (Ord. 08-O-1020A, 8-19-2008, eff. 11-1-2008)
