6-3-2: PROCEDURE FOR APPROVAL OF PRELIMINARY PLAN:
   A.   Action By Subdivider: The subdivider shall cause to be prepared a preliminary plan, which plan shall include all of the property owned or controlled by the applicant, which properties are adjacent to or considered to be contiguous to the proposed subdivision, together with improvement plans and other supplementary material as specified. These shall be submitted to the village administrator, with written application for approval. The preliminary plan and enclosures shall also be submitted directly to the village planner and village engineer and any others as designated by the village administrator. Ten (10) copies of the preliminary plan and all accompanying documentation and the required filing fee shall accompany the application. All materials shall be folded and collated into separate and complete packets.
   B.   Action By Plan Commission/Board Of Appeals: The village administrator shall receive the preliminary plan at least fifteen (15) working days prior to a regular meeting of the plan commission/board of appeals and shall at the same time, instruct the village engineer to collaborate with the plan commission/board of appeals in assembling plans for the design and construction of streets and other such public improvements as are required by this title or any other ordinance of the village.
The plan commission/board of appeals in conjunction with the village planner, village engineer and department heads of the village shall review the proposed subdivision in accordance with the following guidelines:
      1.   Particular Attention Of Plan Commission/Board Of Appeals: The plan commission/board of appeals, in the examination of subdivision plans for approval, and in the application of this title, shall take into consideration the requirements of the community and the best use of the land being subdivided. Particular attention shall be given to width and location of streets, sanitary utilities, storm water drainage, lot sizes and arrangements as well as local requirements such as parks and playgrounds, schools and recreation sites, and other public uses.
      2.   Conformity With Comprehensive Plan: The plan commission/board of appeals shall especially require that all subdivisions conform to the provisions and conditions of the comprehensive plan. Plat approval may be withheld if a subdivision does not conform to the provisions of the comprehensive plan.
      3.   Area Sketch Plan Required: Where a tract of land proposed for subdivision is part of a larger, logical subdivision unit in relation to the village as a whole, the plan commission/board of appeals may, before recommending approval, cause to be prepared by the subdivider a sketch plan for the entire area or neighborhood, such sketch plan to be used by the plan commission/board of appeals as an aid in judging the proposed plat.
      4.   Storm Water Provisions Required: The plan commission/board of appeals shall not recommend for approval by the village board any plat of subdivision which does not make adequate provision for storm water runoff.
      5.   Preservation Of Natural Features: In all subdivisions due regard shall be given to the preservation of natural features such as large trees, watercourses, historical sites or structures and similar features.
The plan commission/board of appeals shall, within two (2) months from the first regular meeting following referral or of the filing by the applicant's last item of required supporting data, whichever date is later, unless such time is extended by mutual consent:
      1.   Recommend approval or disapproval of the proposed preliminary plan and submit its written recommendations, which shall include the recommendations of the village consultants to the village board of trustees; or
      2.   If the plan commission/board of appeals finds that changes, additions or corrections are required on the preliminary plan, the plan commission/board of appeals shall so advise the subdivider in writing. The subdivider may resubmit the preliminary plan to the plan commission/board of appeals for its consideration at the next regular meeting of said commission/board. The plan commission/board of appeals shall, at said meeting, approve or disapprove the preliminary plan and submit its recommendations in writing, which shall include the recommendations of the village consultants to the village board of trustees and the subdivider.
      3.   The village administrator shall notify the owner or subdivider as to the time and place of the plan commission/board of appeals meeting of which he will be afforded an opportunity of being heard.
   C.   Action By Village Board: The village board of trustees shall accept or reject said plan within thirty (30) days after its next regular meeting following the action of the plan commission/board of appeals. The applicant and the village board may mutually agree to extend the one month period.
      1.   Qualifications Of Approval: The following qualifications shall govern approval of the preliminary plan:
         a.   Approval of a preliminary plan by the plan commission/board of appeals and the village board of trustees is tentative only, involving merely the general acceptability of the layout as submitted.
         b.   The plan commission/board of appeals and village board may require such changes or revisions as are deemed necessary in the interest of the needs of the community.
         c.   Approval of the preliminary plan shall be effective for a maximum period of one year, unless upon application of the developer, the village board of trustees grants an extension. The application for said extension shall not require an additional filing fee or the submittal of additional copies of the plan of subdivision.
   D.   Preliminary and final plats of subdivision shall be filed and processed consecutively, unless the Village Administrator determines that the proposed plats can be processed simultaneously. It is the intent that larger, multi-use or complex subdivisions be processed consecutively. Smaller subdivision or re-subdivisions of previously approved subdivisions may be processed simultaneously. The Village Administrator shall make the final determination on whether a plat of subdivision s processed consecutively or simultaneously.
   E.   Subdivisions In Conjunction with Planned Developments: A subdivision may be approved concurrently with a planned development as described in the Zoning Ordinance. (Ord. 99-O-791, 6-7-1999; amd. Ord. 05-O-942, 11-7-2005; Ord. 22-O-031, 12-20-2022)
