4-9-2: APPLICATION OF PROVISIONS AND STANDARDS:
No single-family residence ("subject residence") shall be built in the village which is of the same or similar design as the single-family residences located on the same side of the street on the first or second platted lots on both sides of the subject residence (regardless of intervening streets), directly across the street from the subject residence or immediately to the rear of the subject residence fronting on the first street to the rear of the subject residence. The words "directly across the street" include any lot (covered lot) or portion thereof that falls within the lot lines, as extended, of the subject residence and the first or second lots on both sides of the covered lot. The words "immediately to the rear" include any lot (covered lot) or portion thereof that falls within the lot lines, as extended, of the subject residence and the first or second lots on both sides of the covered lot.
Any elevation of the subject residence shall be deemed to be of the same or similar design to a residence to which it is compared (the "compared residence") unless the subject residence has at least four (4) of the following features different from the compared residence:
   A.   Basic arrangement of the building and its front elevation elements, such as right or left hand orientation (garage, entry, bays, etc.).
   B.   Arrangement and design of windows, shutters, doors, entryway and porches.
   C.   Predominant building color. (Ord. 99-O-792, 6-7-1999)
   D.   Major exterior building materials, such as vertical or horizontal cedar siding, brick/masonry, stone, exterior insulated finishing system (EIFS), or fiber cement board. (Ord. 08-O-1026, 10-6-2008)
   E.   Roof style (hip, gable, mansard, etc.).
   F.   Roofing materials such as wood shingles/shakes, asphalt and terra cotta.
   G.   Site orientation (different elevation facing the street).
   H.   Type of housing (ranch, raised ranch, split-level, two- story).
The building commissioner of the village shall not issue building permit approval unless the plans submitted for approval comply with this chapter. Plans for the subject residence may be resubmitted after they have been modified to meet or exceed the standards for dissimilar design. Appeals from decisions of the building commissioner in regard to this paragraph may be taken by aggrieved persons to the village board of trustees. (Ord. 99-O-792, 6-7-1999)
