4-2-3: DEPOSITS AND COSTS:
Any charges, costs, fees, etc., which may be incurred by the requirements for data to be included in applications for permits shall be paid by the applicant and no costs shall be borne by the village.
   A.   Completion Bond: Prior to issuance of a building permit for the construction of a single-family residence, the building permit applicant, in consideration of the issuance of such permit by the village, shall post a five thousand dollar ($5,000.00) cash completion bond with the village to guarantee the construction of said residence in full and complete compliance with the plans, including all architecture committee recommendations accepted and agreed to by the applicant. In addition, in posting said cash completion bond, the permit applicant acknowledges, accepts and agrees to the following conditions attached to said completion bond:
      1.   Refund: The full amount of the completion bond shall be refunded to the permit applicant upon the happening of the following:
         a.   Completion of construction in full and complete compliance with the plans including the architecture committee recommendations accepted and agreed to by applicant.
         b.   Review and recommendation by the architecture committee. (Ord. 01-O-840, 10-1-2001)
      2.   Major Change: In the event construction results in a major change (as agreed by a majority of the architecture committee) in the overall design intent of the approved plans, and the accepted and agreed to recommendations of the architecture committee, and any such approved changes, the completion bond shall be forfeited, and the village, at its sole option may deposit the proceeds in the general fund and use the proceeds for general fund purposes, or use the proceeds of said cash completion bond for landscaping in public areas.
      3.   Minor Change: In the event construction results in a minor change (as agreed by a majority of the architecture committee) in the materials or overall design intent of the approved plans, and the accepted and agreed to recommendations of the architecture committee, and any such approved changes, the completion bond shall be reduced by the following penalty amounts before a refund is made to the permit applicant:
         a.   Ten percent (10%) per change of color of shutters, doors, trim, roof, etc.
         b.   Ten percent (10%) per change in fenestration, including, but not limited to, ornamental shape windows, mullions, doors, sidelights, shutters, etc.
         c.   Twenty percent (20%) per change in the material selection of the siding, brick, EIFS, stone, etc.
         d.   Twenty percent (20%) per change in roofing material, slope, configuration, canopy placement, and related overhangs and projections; exterior colors, or texture, etc.
         e.   Twenty percent (20%) per change in exterior ornamentation including, but not limited to, fascias, dentils, quoins, keystones, corbels, soldier course, etc.
The penalties shall be forfeited, and the village, at its sole option may deposit the proceeds in the general fund and use the proceeds for general fund purposes, or use the proceeds of said cash completion bond for landscaping in public areas.
      4.   Project Time Limited: The construction project shall be fully completed within eighteen (18) months of the issuance of the initial certificate of occupancy and shall include suitable ground covering such as grass, broadleaf coverage or wood mulch planted or applied to be adaptable to the surrounding area. In the event the project is not fully completed and received a final occupancy permit within said eighteen (18) month period, the permit applicant shall not be entitled to a refund of any portion of his or her cash completion bond, and the village, at its sole option, may deposit the proceeds in the general fund and use the proceeds for general fund purposes or use the proceeds of said cash completion bond for landscaping in public areas.       5.   Penalties: In the event that a permittee or builder has received a reduction of a cumulative one hundred percent (100%) of the refund of prior completion bonds, the completion bond for all future permits shall be increased to ten thousand dollars ($10,000.00). (Ord. 05-O-931, 3-7-2005)
   B.   Code Compliance Bond: Prior to the issuance of a building permit for the construction of all structural improvements or additions, the building permit applicant shall post a cash code compliance bond in the amount of fifty percent (50%) of the principal building permit fees, with a minimum bond of one hundred dollars ($100.00). The code compliance bond will be refunded following the issuance by the building commissioner of an occupancy/use permit. (Ord. 90-O-522, 2-5-1990; amd. Ord. 96-O-715, 3-4-1996)
