Whenever the Board of Local Improvements finds that the public benefit assessment exceeds twenty five percent (25%) of the total amount assessed against public and private property, the Board may provide for any excess to be abated pursuant to section 9-2-114 of the Local Improvement Act to be abated and the judgment reduced entirely to said public benefit assessment.
