§ 36.06 USE OF ACCRUED SICK LEAVE.
   (A)    Every town employee, who has been continuously employed in a permanent position by the Town of Keystone, for at least 7 years prior to the date of the employee's retirement, voluntary resignation, layoff, termination for inability to perform job functions due to physical disability or death, shall receive payment of 45% of the unused leave of absence for sickness which has accrued as of the employee's final day on payroll. Payment shall be made in a lump sum with the employee's last payroll warrant. However, in the case of death of the employee; payment for the accumulated leave of absence for sickness shall be paid as provided under the provisions of SDCL §§ 3-8-8 to 3-8-11 inclusive.
   (B)   An employee may use un-lapsed accrued sick leave in the following situations:
      (1)   Personal illness or off duty injury not incurred in supplemental employment;
      (2)   Illness of a member of his or her immediate family; use of sick leave for this purpose is limited to 5 working days; and
      (3)   Death in the immediate family; use of sick leave for this purpose is limited to 3 days. The immediate family, for purposes above, is: parent, spouse, spouse's parents, child, step-child, step-parent, brother or sister of the employee.
