§ 131.11 FALSELY OBTAINING LODGING OR FOOD SERVICE FROM LODGING OR FOOD SERVICE ESTABLISHMENTS.
   (A)   Any person who shall obtain food, lodging or other accommodations at any lodging establishment or food service establishment as those terms are defined, with intent to defraud the owner or keeper thereof, or any person who shall obtain board or lodging or any other accommodations at any lodging establishment or food service establishment as those terms are defined, by any other than his or her real and proper name, and fail or refuse to pay for the same upon demand, shall be presumed to have obtained the same with intent to cheat or defraud the lodging establishment or food service establishment, and shall be deemed guilty of a misdemeanor.
   (B)   FOOD SERVICE ESTABLISHMENTS as used herein, shall mean any fixed restaurant, coffee shop, cafeteria, short order café, luncheonette, grill, tea room, sandwich shop, soda fountain, tavern, bar, cocktail lounge, night club, roadside stand, catering kitchen, delicatessen, bakery, grocery store, boardinghouse or similar place in which food or drink is prepared for sale or for service to the public on the premises or elsewhere with or without charge.
   (C)   LODGING ESTABLISHMENT as used herein, shall mean any building or other structure and property or premises kept, used, maintained, advertised or held out to the public to be a place where sleeping accommodations are furnished for pay to 2 or more transient guests.
